The Federal Drug Paraphernalia Statute, 21 USC § 863, declares that the “term ‘drug paraphernalia’ means any equipment, product, or material of any kind which is primarily intended or designed for use in manufacturing, compounding, converting, concealing, producing, processing, preparing, injecting, ingesting, inhaling, or otherwise introducing into the human body a controlled substance, possession of which is unlawful under this subchapter. It includes items primarily intended or designed for use in ingesting, inhaling, or otherwise introducing marijuana, cocaine, hashish, hashish oil, PCP, methamphetamine, or amphetamines into the human body…” (emphasis added). In Posters `N’ Things, Ltd. v. United States, 511 U.S. 513 (1994) the Supreme Court of the United States held the following:

  1. The “designed for use” element refers to the manufacturer’s design.
  2. The “primarily intended for use” standard refers generally to an item’s likely use.

The statute refers to ALL materials used to manufacture tobacco accessories; metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes. Pipes with carburetion devices (third holes) are considered to be paraphernalia regardless of the material used to manufacture the pipe. Traditional tobacco accessories like pipes, cigar and cigarette holders and hookah/shisha pipes are not included in the list of contemporary accessories. Columbia River Glass, LLP. exclusively sells products designed by their creators for use as art or for legal use with tobacco products. They are primarily intended for use for legal consumption of tobacco or other legal substances.
